This agreement includes the program itself as well as any attached material such as texts or images.
By purchasing or using this product you agree to this license agreement.
This text has been translated in all conscience from the original license agreement which is in German. Nevertheless it may contain some translation errors. Therefore the official and lawful version is the license agreement in German.
1. Order Process
All information is kept confidential and will not be given to a third party.
The email address is required for basic verification as well as for transmission of the download and registration information. Only with this email address the purchaser is authorized for update-downloads. The purchaser can log-in to the customer area using this email address and a password.
The password along with the email address verifies the purchaser as a unique customer. With this information the purchaser is always able to log-in to the customer area to download the latest version, order other products or change personal data.
After the order the purchaser will receive an email confirmation which will include the required payment information. As soon as the total amount is received, the purchaser will receive the registration information and download instructions by email (usually within one day, at the latest within one week).
2. Purchaser's Commitment
With this order you agree to keep all given data and information confidential and not to pass it on to a third person.
It is strictly forbidden to pass on the purchased product, any attached material as well as your license information in any way (to resell it, to lend it, to rent it, to give it away), to publish it or to use it on more machines than the purchased number of licenses (refer to section 3: "Scope of License").
3. Scope of License
You acquire the right to use the program in its current version under this license agreement.
Furthermore you are authorized to download the latest version in the customer area using your log-in information. This includes all sub-versions (3.x.x) of the "major release" to wit: 3.1.0 or 3.8.3
In the event a new major release is available within one year after the invoice date of a paid order, you are eligible to obtain this as an upgrade free of charge.
By obtaining a single license it is held as a Single-User License. The license is then bound to the personal name of the licensee. The licensee may install the product on a reasonable amount of computer systems, provided that the licensee is - without any exception - the only person able to use the product.
In contrast, obtaining several licenses in a license package entitles the purchaser to install the product on the number of systems corresponding to the number of licenses obtained and may be used by any amount of users. No distinction is made between physical and virtual systems. The license package is bound either to an individual or a company name (which is defined during the order process). That person or company is entitled to determine the systems which the product will be installed on, provided that the authorized number of licenses is not exceeded.
It is permitted to transfer a license from one system to another if the product is first completely removed from the current system.
You can increase your number of licenses at any time by ordering the required amount at the product website.
4. Liability & Warranty
NetSetMan Pro is based on the same functions as the Non-Commercial Freeware version on NetSetMan.
By purchasing this product you confirm that its functionality fulfills your expectations and requirements.
The author clearly points out that it is not possible to create completely errorless software that is also compatible to all operating systems. Therefore you purchase this product "as is".
This product was developed with the utmost care. However, there is the possibility a feature may fail. The author takes no responsibility for this.
The author takes no responsibility for correctness of the product, especially in the event that the product does not meet the requirements and purposes of the purchaser, or does not work in conjunction with other programs.
The author takes absolutely no responsibility for damages of any kind resulting from the use, disuse or other not mentioned damage possibilities.
The author takes no responsibility for correctness of the translations made by third party translators.
It is not possible to assert any demands or compensations subsequently. However, the author strives to fulfill upcoming requirements by continuing the development of the product conscientiously.
The product does NOT contain any kind of spyware or adware. The product will only contact the web server of the author if the user decides to check for an update. The following information will then be transmitted: anonymous query-id (for abuse protection), current product version (to give a corresponding update information), operating system version (for OS specific update information) and product language (for language specific update information). To guarantee your privacy no personal information such as IP addresses will be recorded.
5. Personalization
If you wish to get a special, personalized version of the product (e.g. including a logo) you consent to the fact that only the latest version will be personalized. It is not possible to personalize the product after every update. However, it is possible to get regular adjustments for an additional fee.
6. Legal Claim
The author is both creator and owner of this software and of the used algorithms and procedures. The author holds the legal claim and the possessory claim of this software. The purchaser agrees to the fact that the chosen license is not the sale of the software and that the purchaser has no claims for patents, replication, trade secrets, trademarks or other rights.
7. Copyright
This product is under the legal protection of the copyright and commercial laws of the country in which it is released / used.
It is strictly forbidden to manipulate, translate, decompile or disassemble the software, documentation as well as any related documents and files or any copies of them in whole or in part unless expressly otherwise agreed upon from case to case with the author.
8. Application of Law
This contract is subject to the legislation of the Federal Republic of Germany. It is used as if the concerning legal transactions are taking place in Germany.
9. Additions
The author is entitled to annul the contract immediately if the purchaser does not fulfill the terms of this license agreement.
10. Summary
If one of the terms of this license agreement is ineffective no other point will be affected by that.
In lieu of the ineffective term those effective terms which are closest to the purposes of the intention of the author will apply.
You agree that you have read and understood this license agreement and this is the complete contract between you and Ilja Herlein, which replaces all earlier contracts or agreements of any kind (written, verbal, or any other kind) between you and Ilja Herlein.
